Terms of service

These Terms of Service ("Terms") govern your use of OrderBoost ("the App", "we", "our", or "us"), a Shopify application for post-purchase upsells. By installing or using the App, you agree to these Terms. OrderBoost operates in compliance with Shopify's Partner Program Agreement and Acceptable Use Policy.

Acceptance of terms

By installing OrderBoost on your Shopify store, you agree to be bound by these Terms of Service, our Privacy Policy, and Shopify's Partner Program Agreement. If you do not agree to these terms, do not install or use the App.

Description of service

OrderBoost is a Shopify app that enables merchants to create post-purchase upsell offers. The App displays offers to customers after they complete checkout, allowing them to add additional products to their order with one click. The App operates within Shopify's checkout extension framework and follows Shopify's UX guidelines for post-purchase experiences.

Post-purchase upsell terms

Our post-purchase upsell functionality operates as follows:

• Upsell offers clearly display the product name, image, and price exactly as shown in your store
• Buyers must explicitly accept an offer by clicking the accept button. We do not add charges without explicit buyer consent
• Buyers can decline any offer and proceed to the order confirmation page
• We limit consecutive post-purchase offers to a maximum of 2 per transaction
• Post-purchase pages do not display third-party advertisements or promotions outside of your store's products

Account and eligibility

To use OrderBoost, you must have an active Shopify store with a plan that supports checkout extensions (Basic, Grow, Advanced, or Plus). You must be at least 18 years old or the age of majority in your jurisdiction.

Pricing and payment

OrderBoost offers the following pricing:

• Free plan: Full functionality with upsell revenue capped at $300/month
• Pro plan: $29/month flat fee with unlimited upsell revenue
• All charges are processed through the Shopify Billing API. You authorize Shopify to charge your payment method on file. You can change your plan at any time without contacting support.

Acceptable use

You agree not to:

• Use the App in violation of any applicable laws or regulations
• Use the App in violation of Shopify's Terms of Service, Partner Program Agreement, or Acceptable Use Policy
• Attempt to manipulate or abuse the App's functionality
• Interfere with or disrupt the App's operation or security
• Use the App to sell products prohibited by Shopify's Acceptable Use Policy

Merchant responsibilities

As a merchant using OrderBoost, you are responsible for:

• Ensuring upsell products comply with Shopify's terms and applicable laws
• Maintaining accurate product information, pricing, and images in your Shopify store
• Handling customer service inquiries related to upsell orders

Intellectual property

OrderBoost and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

Limitation of liability

To the maximum extent permitted by law, OrderBoost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the App.

Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or completely secure.

Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may uninstall the App at any time through your Shopify admin.

Changes to terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OrderBoost operates, without regard to its conflict of law provisions.
